| QUESTION: | Under the UBC, gas station islands with a canopy would be classified as an S-3, and we believe the canopy itself to be a building under Section 202. Would the gasoline dispensers then fall under the control and operating mechanism requirements of WAC Section 1105.4.8 and 1106.3? |
| ANSWER: | No. Gasoline dispensers are not scoped as an accessible element
under the purview of Chapter 11, and therefore are exempt from the requirements
of these sections.
Please note that the Americans with Disabilities Act does cover gasoline despensers, and, therefore under the terms of Title III of that Act, the building owner would be responsible to provide reasonable accommodation to the clients using his or her facility. |
