SECTION:  Section 313.4.3
QUESTION:  1. When an adult family home is established in an R3 occupancy, would it be a change of use of an existing building?

2. If the answer to question 1 is yes, Section 313.4.3 requires that the building meet the Chapter 11 accessibility requirements for congregate residences. In Chapter 11, congregate residences do not have to be accessible if there are 10 or fewer occupants. Does the 10 occupants include both the clients and the single family household members?

3. In Chapter 11, congregate residences do not have to be accessible if there are 10 or fewer occupants. Would an LC adult family home having a total of 6 occupants have to be accessible?

3. Yes. Section 313.4.3 requires that if any client is a person with disability, the building shall be altered to comply with congregate residence provisions of Chapter 11. If one or more of the six occupants is a client and is also a person with disability, the building must comply. "The alterations shall provide the minimum necessary access appropriate for the disabilities of the clients."
