Yes, an LC Occupancy, as defined in WAC 51-30-0313, is allowed above
a 3-hour separation specified in UBC 311.2.2.1.
The LC Occupancy designation was created for the state code in order to categorize licensed care facilities regulated by either the Washington Department of Health or the Department of Social and Health Services. The nature of these businesses and their clientele is such that it has been determined that the construction of LC Occupancies have a level of construction and safety similar to that for Group R Occupancies as is reflected in Section 313.2.1.2, Area and Height; Section 313.3, Location on Property; Section 313.4.2, Exit Facilities; and Section 313.4.3, Accessibility. From this, it can be concluded that an LC Occupancy should be able to be located anywhere that a Group R, Division 1 Occupancy is allowed. Since in Section 311.2.2.1 a Group R, Division 1 Occupancy is allowed above a 3-hour separation from a Group S, Division 3 Occupancy, an LC Occupancy should also be allowed in that same location. |
