STATE BUILDING CODE INTERPRETATION NO. 95-22

CODE: 1994 State Regulations for Barrier-Free Facilities
SECTION:  Section 51-30-1105.3.2 D
QUESTION:  Item 4 of Section 1105.3.2 states that platform lifts may be used in lieu of an elevator where existing site or other constraints make use of an elevator infeasible.  In new construction, do designer created building constraints qualify as "other constraints" or "infeasible" as used in this section?
ANSWER:  No.  It was the intent of this section to allow the use of a lift instead of an elevator when restraints such as a superseding and conflicting code section would disallow the use of an elevator or ramp.
